These general terms and conditions of sale are concluded between ZNR DISTRIBUTION SRL, a company with a share capital of €250,000, whose registered office is located at 14, rue de l'autonomie – 1070 Brussels, registered with the Brussels Trade and Companies Register under number BE 0841 338 309, and any natural or legal person wishing to make a purchase through the ZNR DISTRIBUTION SRL website, hereinafter referred to as: kaporalofficial.com

Article 1: Purpose of the Agreement

These General Terms and Conditions of Sale define the contractual relationship between ZNR DISTRIBUTION SRL and the customer, as well as the conditions applicable to any purchase made through the kaporalofficial.com website.

The customer declares:

to be of legal age
to have legal capacity

These GTC take precedence over all other terms and conditions.

ZNR DISTRIBUTION SRL reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on its website. The applicable conditions are those in force on the website at the date of the order. Any order placed on the website implies full and unreserved acceptance of these General Terms and Conditions.

Article 2: Products

The products offered are those listed in the catalogue published on kaporalofficial.com, subject to availability.

ZNR DISTRIBUTION SRL reserves the right to:

modify the product range at any time
limit quantities per customer

Each product is accompanied by a description prepared by ZNR DISTRIBUTION SRL. Photographs are as accurate as possible, but cannot guarantee a perfect likeness, particularly with regard to colors and materials.

ZNR DISTRIBUTION SRL undertakes to deliver products that comply with European regulations on safety and health, in particular legislation on regulated chemical substances.

The products offered include clothing and leather accessories. Leather naturally softens and stretches over time, which may result in slight modifications or changes to the product with use.

Leather products may exhibit:

natural variations
changes over time

This does not constitute a defect.

Article 3: Prices

Prices listed in the catalogue are expressed in euros, inclusive of all taxes (VAT applicable at the date of the order), excluding shipping costs.

ZNR DISTRIBUTION SRL reserves the right to modify its prices at any time. However, only the price displayed on the website at the date of the order will apply.

In the event of a manifest pricing error (software bug, human error, technical issue), the order, even if validated, will be cancelled and the customer will be informed as soon as possible. The customer will then be able to place a new order at the corrected price.

Article 4: Orders and Payment

4.1 Placing an Order

Orders are placed on kaporalofficial.com.

To purchase products, the customer must:

Select the desired product(s) by clicking "Buy" and add them to the cart (after selecting size, color, or quantity).
Review the cart.
Click "Next Step."
Create an account or log in with your email address and password.
Enter shipping and billing information.
Choose a delivery method.
Review your order summary and accept the general terms and conditions.
Choose your payment method and proceed to secure payment.

The customer may check and correct their order details before final confirmation.

4.2 Order Confirmation

Once payment has been approved, the customer will receive an order confirmation email summarizing the items purchased, the delivery address, and the estimated delivery date.

The validation of the order and the confirmation email constitute a contract of sale and acceptance of these general terms and conditions.

ZNR DISTRIBUTION SRL reserves the right to refuse or cancel any order in the following cases:

Abnormal or abusive claims
Abnormal quantities ordered
Abusive returns or exchanges
Existing dispute with the customer

4.3 Payment

Payment is made in full on the day of the order.

Immediate payment via Shopify Payments / PSP:

Bank card
Apple Pay / Google Pay
other available methods

Secure transactions (SSL + certified PSP).

After three unsuccessful attempts, payment will be declined and the customer will be invited to contact customer service at:

ZNR DISTRIBUTION SRL retains ownership of the products until full payment has been received.

All payment information is encrypted via SSL protocol. ZNR DISTRIBUTION SRL does not store any banking data.

Anti-fraud measures

Order data may be processed to prevent fraud. In the event of fraudulent use of a bank card, the relevant information may be recorded in a payment incident file.

The customer accepts that:

anti-fraud checks may be carried out
supporting documents may be requested

ZNR DISTRIBUTION SRL may:

suspend an order
cancel without justification in cases of suspicion

4.4 Order Archiving

Order confirmations are recorded and stored on a reliable and durable medium. The customer agrees that these records constitute proof of the contractual relationship.

Article 5: Delivery

ZNR DISTRIBUTION SRL delivers to France, Andorra, Monaco, Luxembourg, Belgium, Spain, Italy, Germany, Poland, the United Kingdom, Ireland, Sweden, Denmark, and the United States.

Delivery times:

10 business days (international)
6 business days (Belgium)

Orders placed Monday through Thursday before 3:00 PM are processed the same day. Orders placed after 3:00 PM are processed the next business day.

In the event of an unjustified delivery delay, the customer may cancel their order and obtain a refund within 30 days.

Article 6: Acknowledgement of Receipt

The customer must check the condition of the products upon receipt.

Any issue (missing, damaged, or non-conforming product) must be reported within 14 days:

Products must not have been worn and must be returned in their original packaging.

Return shipping costs are the responsibility of the customer.

If non-conformity is confirmed, the customer may choose:

Replacement
Credit note
Refund within 30 days

Article 7: Right of Withdrawal

Customers have 14 days from receipt of the products to return them without justification.

ZNR DISTRIBUTION SRL is not liable for:

Technical failures
Viral contamination

Use of the website is at the customer's own risk.

Article 11: Force Majeure

ZNR DISTRIBUTION SRL shall not be held liable for failure to perform its obligations in the event of force majeure.

If the force majeure event persists beyond one month, the order will be cancelled and refunded within 30 days.

Article 12: Governing Law

These general terms and conditions are governed by Belgian law.

In the event of a dispute, the parties will first endeavour to resolve it amicably. Failing an agreement, the competent courts will be seized.

Article 13: Intellectual Property

ZNR DISTRIBUTION SRL holds all rights to the photos and images on the website.

Any reproduction or use without prior written authorization is strictly prohibited and constitutes an infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code.
